The rights of appropriators to devise their own institutions are not challenged by external governmental authorities.
Ideally CMS and States would actively encourage and permit this community based accountable care by modifying their statutes, rules and regulations.
However, there is probably no regulation at all on things that create positive emotion, engagement, positive relationships, meaning, and accomplishment (PERMA).
The real permission is the ability to retain some of the savings to fund the non-medical interventions that improve wellbeing and reduce the need for medical care.
